General Information on North Carolina Residence for Tuition Purposes at NC State University for Military Personnel and Their Dependents

Note: Decisions on residency for tuition purposes are based on NC G.S. 116-143.1 and 116-143.3 and on A Manual to Assist the Public Higher Education Institutions of North Carolina in the Matter of Student Residence Classification for Tuition Purposes (Manual) which was prepared by the General Administration of the University of North Carolina system. Copies of the relevant statutes and the Manual are available for inspection in the Undergraduate Admissions Office.

The Purpose of this Document

This information sheet was developed to provide general information concerning residence for tuition purposes. This document is not a replacement for the Manual. It attempts to provide information concerning the most commonly asked questions regarding residence for tuition purposes. It does not cover every circumstance, and it is not meant to discourage anyone from applying for residency for tuition purposes.

NOTE: Members of reserve components are not eligible for the Benefit unless they have been called up for active duty, except North Carolina National Guard members on reserve status.

ACTIVE MILITARY AND THEIR DEPENDENTS

NC G.S. 116-143.3. Tuition of active duty personnel in the armed services.

(a) Definitions. - The following definitions apply in this section:

1. The term "abode" shall mean the place where a person actually lives, whether temporarily or permanently; the term "abide" shall mean to live in a given place.

2. The term "armed services" shall mean the United States Air Force, Army, Coast Guard, Marine Corps, and Navy; the North Carolina National Guard; and any Reserve Component of the foregoing.

(b) Any active duty member of the armed services qualifying for admission to an institution of higher education as defined in G.S. 116-143.1(a)(3) but not qualifying as a resident for tuition purposes under G.S. 116-143.1 shall be charged in-State tuition rate and applicable mandatory fees for enrollments while the member of the armed services is abiding in this State incident to active military duty in this State. In the event the active duty member of the armed services is reassigned outside of North Carolina, the member shall continue to be eligible for the in-State tuition rate and applicable mandatory fees so long as the member is continuously enrolled in the degree or other program in which the member was enrolled at the time the member is reassigned.

(c) Any dependent relative of a member of the armed services who is abiding in this State incident to active military duty, as defined by the Board of Governors of The University of North Carolina and by the State Board of Community Colleges while sharing the abode of that member shall be eligible to be charged the in-State tuition rate, if the dependent relative qualifies for admission to an institution of higher education as defined in G.S. 116-143.1(a)(3). The dependent relatives shall comply with the requirements of the Selective Service System, if applicable, in order to be accorded this benefit. In the event the member of the armed services is reassigned outside of North Carolina, the dependent relative shall continue to be eligible for the in-State tuition rate and applicable mandatory fees so long as the dependent relative is continuously enrolled in the degree or other program in which the dependent relative was enrolled at the time the member is reassigned. (d) The burden of proving entitlement to the benefit of this section shall lie with the applicant therefore.

The Criteria for Qualifying

There are two ways a student may receive the in-state tuition rate.

  1. A review of the "Residence and Tuition Status Application" has determined that the student is a resident for tuition purposes. An information sheet titled "General Information on North Carolina Residence for Tuition Purposes at NCSU" which explains this criteria in more detail. If you are active duty military personnel and you are a North Carolina resident then you are eligible for in-state tuition as a resident even if your duty station and location are outside of North Carolina (for example, Korea). You should complete the "Residence and Tuition Status Application".
  2. An active duty military personnel whose permanent duty station and location is in North Carolina and their military dependents are eligible to receive the benefit of in-state tuition even if they are not residents of North Carolina.

Eligibility to Receive the Benefit of In-state Tuition as a Military Personnel or Their Dependent

The Process of Determining Eligibility for In-state Tuition as a Military Personnel or Their Dependent

  1. When applying for admission (as a Non-Degree Studies student or Undergraduate student), indicate if you are a resident and answer the residency questions on the online application (or complete the one-page form included with the paper application for admission). If there is any question about your residency or the 12 month requirement based on the information provided, then you will be classified as a non-resident on this initial classification. Undergraduate applicants are informed of residency status on the acceptance letter.

  2. After this initial classification, you should submit an "Application for the Benefit of In-state Tuition Rate as a Member of the Armed Service or Dependent Relative Thereof" Note the following information concerning the review of this form.

An Example of an Affidavit

The affidavit must be on military letterhead and be signed by the service member's commanding officer or a personnel officer. An example of appropriate wording is:
